Where used in this agreement:
"We" refers to iNEEK Ltd and associated trading names including iNEEK .
"You" includes the person
purchasing the services or any party acting
on the customer's instructions.
"Services"
includes: domain name registration, Web site
hosting, email, consultancy and any other services or facilities
provided by us to you.
"The Registrant"
includes the person applying for a domain
name or any party acting on the Registrant's
instructions.
"The Naming Authority"
is the body which establishes the operational
procedures and rules to which the national
Registration Authority conforms. |

Terms of Service |

All services provided by iNEEK LTD and its associated websites are subject to the general Terms and Conditions outlined in this document. We reserve the right to suspend
or cancel your access to any or all services
provided by us when we decide that the account
has been in breach of this agreement.
iNEEK Ltd reserve the right to refuse
service to any individual or organisation
without reason or notice. |

User Account Information and Privacy Policy |

You as the individual or the person representing an organisation responsible
for all use of your account warrant that you
are at least 18 years of age or otherwise
you have obtained parental consent in order
to sign up for an account.
You agree to provide iNEEK Ltd with
a genuine name, address, email and all other
information required to create an account.
You agree that you will not divulge your account
access information to any other person and
that you will take all necessary precautions
to insure that your access information is
not discovered by other people.
iNEEK Ltd may collect personal information from you via this website or our associated websites if you register with us for services, sign up in order to our newsletter and announcements, or when applying for vacancies.
iNEEK fully endorses and adheres to the principles of data protection. We are a registered data controller with The Information Commissioner's Office. Any personal information you submit to us will always be processed in accordance with the UK Data Protection Act 1998. We will only use the personal information you provide to deliver the services you have requested, or for our lawful, disclosed purposes. We will not make your personal details available to third-parties or organisations without your consent, unless obliged by law.
This website will automatically log certain information such as your IP address, browser identification, operating system and the referring websites. This information is used only for system administration and for statistical analysis of our website. We may also use cookies for collecting certain user behaviours or shopping carts. (A cookie is a small text file created through your browser from a web server and stored on your computer.)
Your personal information is retained by us for as long as the information is relevant to our business purposes or until you request that we remove it from our system. You may request that your information is removed by contacting our Customer Support Team at the address or telephone number detailed below. |

Acceptable use policy |

You agree that you will
not use services provided to you by iNEEK Ltd in any manner which infringes
any law or regulation or that infringes
the rights of any third party. You agree
that , if you purchase any services from
us for use in countries other than UK, you
will take full responsibly to comply with
the law of that country.
We do not allow any of the following contents
to be hosted, uploaded or transmitted:
- Illegal contents including: copyrighted
resources, any for of digital material
in violation of any UK, European, Federal,
State or Local law or regulation.
- Any material that is abusive, threatening,
malicious, profane, or otherwise objectionable
in any way.
- Any material that might cause a threat
to public health, safety or security.
The designation of such material is left
entirely to the discretion of iNEEK Ltd.
- Adult material including: all pornography,
erotic media, otherwise lewd or obscene
content. The designation of such material
is left entirely to the discretion of
iNEEK Ltd.
- Any scripts or application that might
be used for intrusion, scanning or risking
the security of any networks.
- Any scripts or application, client or
server, that might interact or interface
with IRC channels.
- Warez including: pirated software, ROMS,
emulators, phreaking, hacking, password
cracking. IP spoofing, etc., and encrypting
of any of the above. Also includes any
sites which provide "links to"
or "how to" information about
such material. The designation of such
material is left entirely to the discretion
of iNEEK Ltd.
- Any material containing a virus, spyware,
or other hostile computer program.
- Any fraudulent offers to sell or buy
products, items, or services, or to
advance any type of financial scam such
as "pyramid
schemes", "ponzi schemes",
"phishing", "pharming" and "chain
letters."

Spam Policy |

You will not send unsolicited,
or bulk email otherwise known as spam. We
reserve the right to suspend or terminate
any user account that is used to send or promote
spam. The designation of spam or bulk email
is left entirely to the discretion of iNEEK Ltd. If not sure, you should contact
user support before sending multi-recipient,
or mass-mailing list emails. |

Shared Resources and System Stability |
| |
You will not install, run
or otherwise employ any programs or scripts
which might consume excessive system resources
including but not limited to CPU and memory.
We reserve the right to remove or interrupt
any programs or scripts, including but not
limited to chat rooms and CGI scripts, that
might affect the stability of our systems.
Typically no more than 5% of ram or 15 seconds
CPU time is allowed. Users may not use more
than 5% of the total system resources at
an given moment in time.
*Perl-based forums are not allowed on our
servers as they tend to consume excessive
system resources.
*No IRC traffic, of any kind, is allowed
on our servers.
We do not allow any form persistent database
connections. Any account found using excessive
database connections will be suspended immediately.
In such cases we usually contact the user
for making alternative arrangements. |

Service Delivery |
| |
Subject to receipt of full payment and security pass, iNEEK will activate hosting and domain registration services within 24 hours of signup.
Certain services such as web design or dedicated hosting may be subject to different delivery timeframe which will be mutually agreed upon via an agreement prior to signup.

Payments |
| |
Provision of services are dependant
upon receipt of payment in advance. All payments
including hosting fees, domain registration,
or any additional fees must be fully paid
prior to provision by us. Failure to pay will
result in discontinuation of service.
Subsequent payments for recurring services such as hosting are processed automatically unless you submit a cancellation request. Recurring services may be cancelled by you at any time as outlined below. |

Cancellation, Suspension, and Refunds |
| |
iNEEK Ltd reserves
the right to cancel your account at any
time without notice if you break any of
these terms and conditions or fail to
pay any sums due to us.
You may cancel your account at any time by submitting a cancellation request. All cancellation requests are subject to the following conditions:
- iNEEK will fully refund your hosting fee at your request during the first 30 days of signup.
- No refunds will be issued beyond our
30-day money back guarantee.
- 30-day money back guarantee is only applicable
during the initial signup period and it
does not cover renewals or subsequent monthly
payments.
- Certain services such as web design and consultancy
are not refundable.
- Domain registration fees and SSL certificates
are final and non-refundable.
- Setup fees, where applicable, are not
refundable.
- iNEEK will not refund hosting fees
where an account has been suspended due
to violation of our Terms & Conditions.
- 30-day money guarantee does not apply
to certain custom solutions.
- Cheque payments paid to iNEEK Ltd
are subject to a handing fee if a refund
is issued to the customer within 30 days
of order.

Suspension of accounts |
| |
We reserve the right to suspend your account
(usually with notice) if you fail/refuse
to pay any sums due to us, or your account
is found to be in violation of Terms & Conditions.
Where a payment is overdue, your account
will enter a Grace Period of 48 hours and
if we do not receive the overdue payment
during the Grace Period, your account will
be suspended.
Suspended account may be cancelled by us after
30 days of the date of suspension.
All suspended accounts are subject to a reactivation
fee of £15.
We will not release your domain name unless
you pay all sums due to us. |

30-Day Money Back Guarantee |
| |
During the first 30 days of your account
activation you are entitled to a full
refund of the hosting fee excluding: domain
name registration, SSL certificates, Web
design, consultancy, or any other non-refundable
fees. Refunds are made either by cheque
or a credit to the credit card used to
purchase the service.
Where a domain name has been transferred
in by us, a £10.00 admission fee is
deducted from the refund.

| 7. |
Domain Name Registration |
| |
We make no representation that the domain
name you wish to register is capable of being
registered by or for you or that it will be
registered in your name. You should therefore
not assume registration of your requested
domain name(s) until you have been notified
that it has or they have been registered.
Any action taken by you before such notification
is at your risk.
The registration and use of your domain name
is subject to the terms and conditions of
use applied by the relevant naming authority;
you will ensure that you are aware of those
terms and conditions and that you comply with
them. You will have no right to bring any
claim against us in respect of refusal to
register a domain name.
All domain name sales are final. We will not
refund any fees in respect of domain name
registration. You may not transfer your domain
name to another registrar within the first
60 days the registration. We will, however,
assist you with any necessary configurations
required to point your domain name to other
name servers.
We will have no liability in respect of the
use by you of any domain name; any dispute
between you and any other person must be resolved
between the parties concerned in such dispute.
If any such dispute arises, we will be entitled,
at our discretion and without giving any reason,
to withhold, suspend or cancel the domain
name. We will also be entitled to make representations
to the relevant naming authority but will
not be obliged to take part in any such dispute.
Domain names that have been registered by
us free of charge, will incur the standard
registration fee before being released to
another host. |

Service Availability |
| |
While striving to maintain
a highly available service, iNEEK Ltd
makes no warranties of any kind that service
will be uninterrupted of or error free. We
will not, in any event, be liable for interruptions
of service or downtime of the Server. iNEEK Ltd will have the right to suspend
or interrupt the services for maintenance,
security or for any reason and at any time,
and without notice.

Backup and Data Loss |
| |
iNEEK Ltd offers no guarantee
to backup your data. We will not be held liable
for any loss or damages to your data caused
by the use, misuse, unavailability, or system
failure. You will agree to take full responsibility
to maintain and backup all your data stored
on our servers. |
| 10. |
Indemnification |
| |
You will indemnify us and keep
us indemnified and hold us harmless from and
against any breach by you of these terms of
business and any claim brought against us
by a third party resulting from the provision
of Services by us to you and your use of the
Services and the Server including, without
limitation, all claims, actions, proceedings,
losses, liabilities, damages, costs, expenses
(including reasonable legal costs and expenses),
howsoever suffered or incurred by us in consequences
of your breach or non-observance of this Agreement.
iNEEK Ltd assumes no liability of the
Client for failure to follow this Agreement
and any results caused by the acts, omissions
or negligence of the Client, subcontractor
or an agent of Client or an employee of any
one to them, including, but not limited to,
claims of third parties arising out of or
resulting from or in connection with the Client's
products, messages, programs, caller contracts,
promotions, advertising, infringement or any
claim for libel or slander or for violation
of copyright, trademark or other intellectual
property rights |

Changes to this Agreement |
| |
iNEEK Ltd reserves the
right to revise, change, or modify this agreement
at any time without notice. |
